Preamble
These general terms and conditions of sale are concluded between, on the one hand, the SARL EOCREP, whose registered office is located at 20, route de l'Orme au Loup, 18300 Ménétréol sous Sancerre, registered with the Bourges Trade and Companies Register, with a capital of €10,000, hereinafter referred to as "EOCREP," and on the other hand, any individual or legal entity wishing to make a purchase via the online sales site www.eocrep.com, hereinafter referred to as the "Client."
Purpose and Scope
These general terms aim to define the conditions of sale between EOCREP and its Clients. They specify the general conditions for the realization of the various stages of the sale, from placing the order and payment, to the delivery of the products, and ensure the follow-up of this order between the parties. These general terms and conditions of sale govern the sale of products on EOCREP's merchant site. EOCREP will deliver to mainland France and certain European countries.
The Order
The Client can only place an order through our site: www.eocrep.com. For any other form of order, please contact us. The Client agrees to create an account and provide the following information: Company name, registered office, Trade Register number, SIRET and VAT numbers (if applicable), name, first name, full address, phone number, and email of the contact person. The legal conditions for exercising online purchases are provided by Law No. 2014-344 related to consumption. The order is formalized and constitutes an irrevocable commitment, except for the legal withdrawal period (Art. L 121.21), when the Client clicks the validation button on the site. Payment is mandatory to confirm the order.
EOCREP reserves the right to refuse an order. The General Terms and Conditions of Sale are available at the bottom of the site page. By checking the box "I have read and accept the general terms and conditions of sale" before validating the order, the Client expressly and unreservedly accepts these General Terms and Conditions of Sale.
EOCREP will automatically send a purchase confirmation email and an acknowledgment of receipt of the payment.
Free Sample Sending
Free sample sending is only available to professionals or people with a professional project for selling crêpes and galettes. Individuals or people outside France can order a sample with a handling fee of €5 including tax. The Client can order a free sample through our site: www.eocrep.com. Only one request per person (or project or company). EOCREP reserves the right to refuse a sample request.
Availability
Items are in stock unless otherwise stated on the site and will be shipped as soon as possible. Prices are given excluding VAT (the amount of VAT is indicated at the time of the order), in Euros, and excluding shipping costs. Prices are subject to change depending on potential supplier price variations, VAT, or during promotions. Any typographical error by EOCREP will be corrected within 48 hours and will not be attributable to it.
Order Payment
By online credit card (CB, Visa, Mastercard). Data entered by the client is encrypted and processed by Crédit Agricole, the only one able to decipher it. Encryption is performed according to the SSL -Secure Socket Layer- protocol, used for online purchases worldwide. By bank transfer and check payment: products are shipped as soon as possible after payment is received.
Any payment delay will automatically result in the payment of late fees at a rate of 3 times the legal rate and a fixed recovery fee of €40 excluding tax without any formal notice.
Shipping and Delivery Charges
Shipping is free for orders over €195 excluding tax in France. Below this amount, shipping costs are calculated based on the weight/volume ratio of the order and are borne by the client. The amount of shipping costs is clearly indicated before order validation. EOCREP outsources the delivery service and cannot be held responsible for any inconvenience caused by the transport company. Delivery times (usually between 48 and 72 hours) are given as an indication only and without guarantee. Delivery delays do not entitle the buyer to cancel the sale or refuse the goods. They cannot result in retention, compensation, penalties, or damages. In case of a delay of more than eight days after the expected receipt date, the Client must inform EOCREP so that necessary action can be taken to resolve the issue.
To facilitate delivery, EOCREP will provide any information the Client can give, as well as their phone number. The client agrees to provide all necessary information for a smooth delivery and to be present for at least 5 consecutive hours on the delivery day. The Client agrees to check the condition of their parcels and possibly make reservations on the delivery note in the presence of the carrier. Any accepted parcel cannot be contested.
Force Majeure
Cases of force majeure could hinder the proper execution of an order and/or delivery, automatically suspending execution after a certain period: strikes, natural disasters, etc. These cases add to those usually recognized by French jurisprudence.
Claims and Withdrawal
In case of a non-compliant product or an error in the sent product, the client can return it to EOCREP, which reserves the right to take it back, exchange it, or refund it, provided the error is EOCREP's fault. Any claim will be considered amicably and sensibly but must be made within fourteen days of delivery. Article L121-16 of the Consumer Code: the client has a withdrawal period of 14 working days from the day of receipt of their order. EOCREP will refund the order (items and shipping costs) within 14 days after being informed of the exercise of the right of withdrawal. EOCREP must be informed as soon as possible of the withdrawal intention to send the withdrawal form to the client and organize the collection of the goods. Return shipping costs are borne by the client. In any case, incomplete, damaged, opened, or soiled items by the client will not be taken back.
Hygiene
Any action and product related to the preparation and packaging of food products require constant and rigorous hygiene for all parts in direct or indirect contact with them. The items are supplied in good hygienic conditions. EOCREP is not responsible for any damage caused by non-observance of sanitary rules.
Contract Conclusion – Data Protection
The contract is validly concluded when the client, after checking the details of their order, its total price, and correcting any errors, has confirmed it by clicking the validation button, expressing their acceptance. According to Article 34 of the "Data Processing and Liberties" law of January 6, 1978, the automatic processing of information, including the management of users' email addresses, has been declared to the CNIL under registration number 1719176. EOCREP is not responsible for the content of other sites whose link is accessible via the www.eocrep.com site.
Intellectual Property
It is strictly forbidden for anyone to use for any purpose the information or images appearing on the site, all elements are subject to intellectual property rights.
Competent Court
In case of a dispute regarding the interpretation or execution of this contract, the Bourges Commercial Court will have sole jurisdiction, even in the event of a warranty appeal or multiple defendants. All our sales are subject to French law.
