Preamble :

The present general terms and conditions of sale are concluded between, on the one hand, SARL EOCREP, whose registered office is at 20, route de l'Orme au Loup, 18300 Ménétréol sous Sancerre, registered in the Bourges Trade and Companies Register, with a capital of €10,000, hereinafter referred to as "EOCREP" and, on the other hand, between any individual or legal entity wishing to make a purchase via the online sales site www.eocrep.com, hereinafter referred to as the "Customer".

 

 

Object and scope of application:

The present general terms and conditions are intended to define the terms and conditions of sale between EOCREP and its Customers. They specify the general conditions for carrying out the various stages of the sale, from the placing of the order and payment to the delivery of the products and ensure the follow-up of this order between the parties. These general terms and conditions of sale govern the sale of products found on the EOCREP merchant site.

EOCREP will ensure its deliveries in Metropolitan France and certain European countries.

The Customer agrees to create an account and to provide the following information:

Name of his company, registered office, RCS, Siret number and intra-community VAT number (if applicable), surname, first name, full address, telephone, e-mail of the contact person.

The legal conditions of exercise of the online purchase are provided by the Law N°2014-344 relating to consumption. The order is formalized and constitutes an irrevocable commitment, except for the legal period of retraction (Art. L 121.21), during the "Click" of validation on the site by the Customer. Payment is mandatory to confirm the order.

 

EOCREP reserves the right to refuse an order.

Sending of samples :

The sending of samples is intended for professionals or people with a professional project of selling crêpes and galettes. Individuals or companies outside France can order a sample with a contribution to the processing and shipping costs. The Customer can place an order for a sample shipment through our website: www.eocrep.com, we'll notify the shipping costs depending on the destination.

EOCREP reserves the right to refuse a request to send a sample.

 

 

At your disposal :

Items are in stock unless otherwise stated on the site and will be shipped as soon as possible.

Prices: Our prices are given exclusive of VAT and with VAT (the amount of VAT is clearly indicated at the time of the order), in Euros and exclusive of shipping costs. The prices are likely to evolve according to possible variations in the prices of the suppliers, the VAT, or during promotions. Any typographical error on the part of EOCREP will be corrected within 48 hours and will not be attributable to it.

 

 

Payment of the Order:

By credit card online (CB, Visa, Mastercard). The data entered by the customer is encrypted and then processed by the Crédit Agricole, which is the only one able to decipher it. Encryption is carried out according to the SSL protocol -Secure Socket Layer-, used for purchases on the Internet worldwide.

By bank transfer: products are shipped as soon as possible after receipt of payment.

For payment by check, please contact us. Any delay in payment will automatically and without any formal notice being necessary engender late payment penalties on the basis of 3 times the legal rate and the payment of a lump-sum compensation for collection costs of 40 € HT.

 

 

Delivery and Postage:

Shipping costs are free from 185 € HT only in France. Below this amount and for shipping abroad, shipping costs are calculated according to the weight/volume ratio of the order and are charged to the customer. The amount of the shipping costs is clearly indicated before the validation of the order.

 

 

EOCREP subcontracts the delivery and cannot be held responsible for any inconvenience caused by the transport company.

Delivery times (generally between 48h and 72h) are given for information only and without guarantee. Delays in delivery do not give the buyer the right to cancel the sale or to refuse the goods. They may not give rise to withholding, compensation, penalties or damages. In the event of a delay of more than eight days after the expected date of receipt, the Customer must inform EOCREP so that the necessary steps can be taken to find a solution.

In order to enable the deliverer to make the delivery in the best possible conditions, EOCREP will report any information that the Customer may give it as well as its telephone number. The Customer undertakes to provide all the information necessary for the proper conduct of the delivery.

The Customer undertakes to check the condition of his/her package(s) and to express any reservations on the delivery slip in the presence of the carrier. Any package accepted cannot be contested.

 

 

The case of absolute necessity:

Cases of force majeure could hinder the good realization of an order and/or a delivery and suspend automatically the execution after a certain delay: Strikes, natural disasters,... These cases are in addition to those usually retained by French jurisprudence.

 

 

Claim and retraction :

In the event of a non-compliant product or an error on the product sent, the customer may return it to EOCREP, which reserves the right to take it back, exchange it or reimburse it, provided that the error is at the initiative of EOCREP. Any claim will be considered in good faith and with common sense, but must be made within fourteen days of delivery.

Article L121-16 of the Consumer Code: the customer has a withdrawal period of 14 working days from the day of receipt of his order. EOCREP will reimburse the order (articles and shipping costs) within 14 days after having taken note of the exercise of the right of withdrawal. EOCREP must be informed as soon as possible of the intention to retract in order to send the retraction form to the customer and organize the collection of the goods. The costs of returning the goods shall be borne by the customer. In any event, items returned incomplete, damaged, opened or soiled by the customer will not be taken back.

 

 

Hygiene:

Any action and any product related to the preparation and packaging of food products require constant and rigorous hygiene for all organs that are in direct or indirect contact with them. The articles are supplied in good hygienic conditions. EOCREP is released from any responsibility in the event of damage caused by the non-observance of sanitary rules.

 

 

Conclusion of the Contract - Data Protection :

The contract is validly concluded when the customer, after having been able to verify the details of his order, its total price and correct any errors, has confirmed it by a validation click, expressing his acceptance.

According to article 34 of the law "informatique et liberté" of January 6, 1978, the automatic processing of information, including the management of e-mail addresses of site users, has been the subject of a declaration to the CNIL, whose registration number is 1719176.

Intellectual property rights

It is strictly forbidden to any person to use for any purpose whatsoever the information or images appearing on the site, all elements are subject to intellectual property law.

 

 

The competent court :

In the event of a dispute relating to the interpretation or execution of this contract, the Commercial Court of Bourges will have sole jurisdiction, even in the event of appeal in guarantee or plurality of defendants. All our sales are subject to French law.
